The website provides corporate, capability, stakeholder and contact information about ALG and its current business activities. Certain services described may be delivered by separate operating entities, specialist providers, subcontractors or partners, as applicable.
No automatic offer, appointment or contract
Website content, capability statements, service descriptions, project examples, downloadable documents, requests for proposals and contact forms are provided for general information and business-development purposes. Unless expressly stated otherwise, they do not constitute a binding offer, quotation, warranty, appointment, investment solicitation or contractual commitment by ALG or any operating entity.
A contract for goods, services, projects, rentals, professional work or other commercial activity is created only when the relevant parties complete the applicable approval process and enter into a written agreement, accepted quotation, purchase order or other authorised arrangement. A website enquiry alone does not create a contract or reserve capacity.
Service availability and capability statements
ALG seeks to keep website information accurate and current, but service availability may depend on geography, capacity, mobilisation, licensing, statutory approvals, safety requirements, specialist resources, procurement processes, client requirements and the specific operating entity responsible for delivery.
Any statement about a capability should be read together with the commercial proposal or contract issued for the relevant engagement. Do not rely on the website as confirmation that a particular licence, certification, product, specialist resource or service is available for a specific project without written verification.
Permitted use
You may access and use the website for lawful business, informational, research, recruitment, procurement, partnership and reference purposes. You may download or print publicly available materials for internal, non-commercial reference, provided copyright and proprietary notices are retained and the material is not misleadingly altered.
Prohibited use
- Using the website for unlawful, fraudulent, deceptive, defamatory, abusive, discriminatory or malicious activity
- Attempting to obtain unauthorised access to the website, servers, systems, accounts, databases or network infrastructure
- Introducing malware, malicious code, automated attack traffic, denial-of-service activity or other harmful technology
- Scraping, harvesting or systematically extracting personal information, contact details or protected content in a manner that infringes law, privacy rights, intellectual property rights or reasonable technical restrictions
- Impersonating ALG, an operating entity, employee, supplier, client or other person
- Using ALG names, marks, logos, imagery or content to suggest sponsorship, approval, partnership or association that does not exist
- Framing, mirroring or reproducing substantial portions of the website for commercial exploitation without prior written permission
- Interfering with security controls, access restrictions, logs or protective measures
Intellectual property
Unless otherwise indicated, website content including text, graphics, logos, designs, layouts, photographs, videos, documents, databases, software elements and other material is owned by, licensed to or lawfully used by ALG or the relevant rights holder, and may be protected by copyright, trademark, design, confidentiality and other intellectual property laws.
Nothing in these Terms grants ownership of ALG intellectual property or a licence to use ALG branding for commercial, promotional or endorsement purposes. Requests for commercial reproduction or brand use must be submitted in writing to ALG.
Submissions, recruitment and suppliers
You remain responsible for information and materials you submit through the website. You must have the right to submit the information and must not knowingly submit unlawful content, malicious code, confidential information belonging to a third party without authority, or personal information you are not entitled to disclose.
ALG may use an enquiry and the contact information supplied with it to respond, route the matter internally or to the relevant operating entity, perform appropriate due diligence, keep reasonable business records and manage the relationship in accordance with the privacy policy.
Submitting a CV, supplier document, tender response or business proposal does not oblige ALG to appoint, employ, shortlist, register, procure from or contract with the sender. Any recruitment or procurement process may be subject to separate criteria, verification, due diligence, approvals and contractual requirements.
External links, availability and security
Links to third-party websites are provided for convenience or reference and do not necessarily constitute endorsement. ALG does not control third-party websites and is not responsible for their availability, content, privacy practices, security or terms. You access external resources at your own risk.
ALG may change, suspend, withdraw, restrict or update any part of the website without notice where reasonably necessary for maintenance, security, legal compliance, business changes or content management, and does not guarantee uninterrupted or error-free access.
ALG applies reasonable measures to protect the website and information submitted through it. You are responsible for the security of your own devices, networks and communications, and should not treat ordinary email or a general contact form as an appropriate channel for highly sensitive information unless specifically instructed otherwise.
Accuracy and general disclaimer
ALG takes reasonable care in preparing website content but does not warrant that all information is complete, current, error-free or suitable for every purpose. Industry, regulatory, pricing, technical, project and service information may change. Obtain current written information before making a material commercial, legal, investment, procurement, technical or safety decision.
Nothing on the website constitutes legal, tax, financial, investment, engineering, safety, medical or other regulated professional advice unless specifically issued as such by an appropriately qualified person under a separate engagement.
Limitation of liability and indemnity
To the fullest extent permitted by South African law, ALG will not be liable for indirect, incidental, special, punitive or consequential loss arising solely from access to, inability to access, or reasonable reliance on general website content, including loss caused by third-party websites, temporary downtime or malicious activity beyond ALG's reasonable control. Nothing in these Terms excludes or limits liability that may not lawfully be excluded or limited.
A user who unlawfully misuses the website, infringes third-party rights, introduces malicious code, impersonates ALG or breaches applicable law may be responsible for losses, claims, costs or liabilities reasonably arising from that conduct, subject to applicable law.
Electronic communications
A message submitted through the website or sent by email is not necessarily deemed received by ALG merely because it was transmitted. For time-sensitive or legally significant communications, obtain written acknowledgement from an authorised ALG representative. A website submission does not constitute formal service of legal process or acceptance of contractual terms.
Governing law, consumer rights and changes
These Terms are governed by the laws of the Republic of South Africa. Subject to any mandatory consumer or statutory rights, disputes arising from use of the website are subject to the jurisdiction of the competent South African courts.
Nothing in these Terms is intended to waive or limit rights that cannot lawfully be waived or limited under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 or any other applicable law.
ALG may revise these Terms when the website, business operations or applicable law changes. The latest version published on the website states its effective date, and continued use after publication constitutes acceptance to the extent permitted by law. If any provision is found invalid or unenforceable the remaining provisions continue to apply, and a failure to enforce a provision on one occasion does not waive the right to enforce it later.
Personal information collected through the website is handled in accordance with the privacy policy, the POPIA statement and applicable law. Questions about these Terms may be sent to info@asibongelegacygroup.co.za.
